Is Vaping Legal in Dubai and the UAE? A Straight Answer

It is the question we get asked more than any other, usually phrased nervously. The short answer: yes, vaping is legal in the UAE — and has been since 2019. But legal to buy is not the same as legal to use anywhere, and the difference is where people get caught out.

What changed in 2019

Before April 2019, e-cigarettes and vaping products could not be legally sold in the UAE. That year the Emirates Authority for Standardization and Metrology introduced a standard covering electronic smoking devices, and regulated sales began. Since then, vaping products that meet UAE standards can be sold and used legally by adults.

The practical effect is that the grey market shrank and licensed retail grew. It also means the products you buy should be UAE-compliant — which is worth checking, because non-compliant imports still circulate.

You must be 18 or over

Vaping products contain nicotine and are restricted to adults. Any legitimate UAE retailer will verify your age at checkout and again on delivery — ours do, and you may be asked for an Emirates ID, passport or UAE driving licence when your order arrives. Where you can and cannot vape

This is the part that actually gets people fined. In general, vaping is treated the same as smoking. Assume you cannot vape anywhere you could not light a cigarette:

• Indoor public spaces — shopping malls, cinemas, offices, restaurants and cafes unless there is a designated smoking area
• Government buildings and healthcare facilities
• Public transport — the Metro, buses, taxis. The Dubai Metro in particular is strictly enforced
• Mosques and places of worship
• Schools, universities and the areas around them
• Cars carrying children

Designated smoking areas, most outdoor spaces and private residences are generally fine. Individual venues, buildings and communities can set stricter rules than the law requires, so signage wins — if a sign says no, that is the answer regardless of what is technically permitted.

During Ramadan

Vaping in public during daylight hours in Ramadan is treated the same as eating, drinking or smoking in public. Be discreet and use private or designated spaces.

Bringing a vape into the UAE

You can generally bring a personal-use device with you when you travel. Practical points that catch people out:

• Devices and spare batteries must go in cabin baggage, never checked luggage — this is an airline safety rule, not a UAE one, and it is enforced everywhere
• Do not vape on the aircraft, including in the lavatory
• Carry personal quantities, not commercial ones. Arriving with a suitcase of stock looks like importing for resale
• Products should meet UAE standards

How to tell if a product is legitimate

Counterfeits are the real risk in this market, and they are common with the best-known brands. A few signals worth checking:

• Buy from a retailer that names its business and publishes real policies — not an anonymous Instagram account
• Check for a scratch-and-verify authenticity code where the brand uses one
• Be suspicious of prices well below the market. Genuine stock has a floor
• Look at the nicotine labelling — compliant products state the strength clearly

The honest caveat

Legal does not mean risk-free. Nicotine is addictive, and vaping products are intended for adults who already smoke or vape — not for non-smokers, under-18s, or anyone pregnant or breastfeeding.
